What types of accident could qualify for compensation?

What entitles me to compensation?

A. If you have been injured in an accident that was not your fault, within the last three years, you could be entitled to claim compensation. Compensation can be claimed for your injuries and also for loss of earnings and any related medical expenses. One of our specialist team of personal injury solicitors will assess whether you are likely to be successful in pursuing a claim.

How much compensation am I entitled to?

A. This all depends on the extent of the injuries and other losses you have suffered. Average compensation claim amounts range from £2,000 up to £10,000 or more. Serious or persistent injuries tend to result in substantially higher compensation amounts. Loss of earnings, out of pocket expenses and medical expenses are also recoverable.

How will my case be handled?

A. It all starts with an initial no obligation consultation on the phone to ascertain whether we believe you are entitled to compensation. This may be followed up by a meeting at your local WINWales solicitor’s office, at home or in hospital, if necessary. If you decide to proceed, you will deal with the same person throughout the duration of your case. To minimise any inconvenience to you, the majority of the correspondence will take place via phone or letter and all details are treated in the strictest confidence.

How much will it cost me?

A. Nothing. If you win your case your costs will be recovered from the losing party and our solicitors will guarantee that you will receive 100% of your compensation.

Are there any other costs that I will have to pay for, such as medical examinations?

A. No. WINWales will make all the necessary arrangements for any medical reports, and the costs will be recovered – together with the cost of any treatment such as physiotherapy - from the losing party at the end of the case.

How do WINWales solicitors get paid?

A. In April 2000 a change in the law abolished legal aid for personal injury. Today all costs are recovered from the losing party, and even if your claim is unsuccessful, an insurance policy covers all costs involved in the claim. WINWales solicitors enter into a Conditional Fee Agreement in relation to their legal costs.

Is there a time limit for submitting a claim for a personal injury?

A. There is a time limit of 3 years from the date of the accident for the majority of claims, and a claim can be submitted at any stage during this period. However, there are some circumstances, for instance in cases involving children, where claims can be submitted after a longer period of time – to find out more please contact us. It is always best to submit a claim as quickly as possible to have more chance of being successful with your claim, as it helps us to build a stronger case.

How long will my claim take to settle?

A. This depends on the extent and nature of your injuries and the exact circumstances of the accident. On average, personal injury claims can take between 18 months and three years from start to finish. At WINWales we are committed to speeding up the claim process, so we aim to resolve straightforward cases within 12 months. For more serious injuries the process may take longer, but we promise to cut out any unnecessary delays.

Will I have to go to court?

A. Our aim is to get you the maximum compensation possible, and in most cases, we can achieve this without the need to go to court. Sometimes, however, we do have to go to court to get the compensation you deserve. In these cases you can be sure of the full support of your solicitor and, if needed, specialist barristers.

What if I lose my claim?

A. All cases are taken on a No Win No Fee basis. This means that if your claim is unsuccessful, you don’t pay a penny.
